FoldingFins® Refund & Return Policy

EXOTECH Sp. z o.o. ("EXOTECH", "we", "us") is committed to customer satisfaction. This policy describes how to return a FoldingFins® product purchased directly from foldingfins.com.

Summary

  • 30 days from delivery to request a return — extended beyond the 14-day legal minimum.
  • Product must be in saleable condition — basic at-home inspection allowed; products showing actual use are subject to value reduction or refund denial.
  • Customer pays return shipping (typically €15-30 within EU, $30-60 international).
  • Refund within 14 days of receiving the declaration of withdrawal, provided the product is returned in acceptable condition.
  • Original packaging required (or equivalent protective packaging if original was damaged in transit).

Right of Withdrawal — Extended Terms

FoldingFins voluntarily extends the consumer withdrawal window to 30 days from the date of delivery, beyond the 14-day minimum required by Art. 27 of the Polish Consumer Rights Act. The Customer's statutory 14-day right under EU/Polish consumer law remains in full force; the additional 16 days are a contractual extension granted by the Seller.

This policy applies only to Consumers as defined under Art. 22¹ of the Polish Civil Code (natural persons making purchases unrelated to business or professional activity). Business-to-business (B2B) purchases are not covered by the right of withdrawal.

Starting Date for the 30-Day Return Period

The 30-day withdrawal period begins on the date the Customer (or a third party indicated by the Customer, other than the carrier) takes physical possession of the Product, in line with Art. 28 of the Polish Consumer Rights Act.

Proof of Delivery Date

To exercise the right of withdrawal, the Customer must provide proof of the delivery date. Acceptable proof:

  • Carrier tracking confirmation showing "Delivered" status with timestamp (FedEx, DPD, GLS, DHL, or other carrier used by the Seller)
  • Signed delivery receipt (if applicable)
  • Delivery confirmation email from the carrier

If the Customer cannot provide proof of delivery date, the Seller will use the carrier-recorded delivery timestamp as the start date. If no carrier-recorded timestamp is available, the start date defaults to 7 days after the dispatch date.

If the Customer claims the carrier delivery confirmation is incorrect (e.g., package marked as delivered but not actually received), the Customer must initiate a carrier investigation within 7 days of the disputed delivery confirmation. Failure to initiate carrier investigation within this window precludes disputing the delivery date for the purpose of the 30-day window.

How to Request a Return

Step 1 — Submit declaration of withdrawal (within 30 days of delivery)

Email info@foldingfins.com with subject line RETURN REQUEST – Order #[your Shopify order number]. Include:

  • Your Shopify order number (from the order confirmation email)
  • Date of delivery + proof of delivery (carrier tracking confirmation, delivery email, or signed receipt)
  • Reason for return (optional, helps us improve)
  • Confirmation that the product is in saleable condition

You may use the model withdrawal form available as Annex 1 below. Use of the form is optional — a clear declaration via email is sufficient.

Step 2 — Acknowledgment (within 2 business days)

EXOTECH confirms receipt of your declaration via email and provides the return shipping address.

Step 3 — Ship the product back (within 14 days of declaration)

The Customer ships the Product to:

Customer covers return shipping costs. We recommend a tracked and insured shipping method. The 14-day return shipping deadline is met if the Product is dispatched (postmarked) before the 14 days expire.

Step 4 — Inspection (within 5 business days of receipt)

EXOTECH inspects the returned Product, documents its condition with photographs, and determines the refund amount based on the condition (see "Saleable Condition" and "Value Reduction" sections below).

Step 5 — Refund (within 14 days of declaration of withdrawal)

EXOTECH refunds the Product price (less any value reduction) using the same payment method used for the original purchase, unless the Customer expressly agrees to an alternative method.

The refund excludes: - Original delivery costs (if not paid as free shipping) - Any additional costs resulting from a delivery method other than the cheapest standard delivery offered

EXOTECH may withhold the refund until the Product is received and inspected, or until the Customer provides proof of return shipment, whichever occurs first.

Saleable Condition

The Product must be returned in saleable condition, defined as:

  1. Original packaging (or equivalent protective packaging if original packaging was damaged in transit)
  2. All components included: 2 fins, 8 adjustment pins (full set), 2 bungee straps (both sizes), 1 adjustment key, original user manual, original packaging materials
  3. Inspection-only condition — the Product may have been inspected to establish its nature, characteristics, and functioning, in line with Art. 34 of the Polish Consumer Rights Act. This includes: - Unboxing the Product - Inspecting visually and by touch - Dry try-on at home (without immersion in water) - Testing the folding mechanism manually (without applying force)
  4. No actual use — the Product must NOT show signs of actual use beyond inspection, specifically: - No exposure to saltwater or chlorinated water - No abrasion, scratches, or marks consistent with use on rough surfaces (seabed, rocks, coral, sand) - No worn non-slip pads - No salt deposits, sand, or biological residue (algae, organic matter) - No signs of forced bending, twisting, or component disassembly

Value Reduction for Use Beyond Inspection

The Customer is responsible for any reduction in the Product's value resulting from use beyond what is necessary to establish its nature, characteristics, and functioning. The Seller will assess returned Products and may withhold a portion of the refund corresponding to the loss in resale value:

Heavy use (multiple dives, significant abrasion, deformed mechanism, missing or damaged components, signs of forced bending or tampering) Refund denied or reduced to scrap value (typically 0-10% of original price)

EXOTECH will document the condition of returned Products with photographs at the time of receipt and provide written justification for any value reduction. Disputes regarding value reduction are handled per the complaint procedure in our Terms of Use.

Exclusions from the Right of Withdrawal

In line with Art. 38 of the Polish Consumer Rights Act, the right of withdrawal does NOT apply to:

  • Products manufactured to the Customer's specification or serving individual needs (custom-made items)
  • Products delivered in a sealed package which cannot be returned after opening due to health or hygiene reasons (does not currently apply to FoldingFins® products)
  • Other categories listed in Art. 38 of the Polish Consumer Rights Act

Standard FoldingFins® products purchased through foldingfins.com are not subject to these exclusions.

Defective Products — Statutory Warranty (Rękojmia)

This policy covers the right of withdrawal (return for any reason or no reason). For defective products, separate statutory rights under EU/Polish consumer law (rękojmia) apply, with a 2-year warranty period from delivery. Out-of-Court Dispute Resolution

In the event of a dispute, you may use out-of-court complaint and redress procedures, including the EU Online Dispute Resolution platform at http://ec.europa.eu/consumers/odr/. You may also contact the Polish Office of Competition and Consumer Protection (UOKiK) at http://www.uokik.gov.pl/spory_konsumenckie.php. Use of out-of-court procedures is voluntary, and both parties must agree to the procedure.
